Welcome to CareLookout. By downloading, accessing, or using the CareLookout application ("the App") available at carelookout.com and through the Apple App Store and Google Play Store, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
CareLookout is a mobile application that helps users search for, compare, and evaluate senior care facilities across the United States. The App provides facility information sourced from public government databases, AI-generated safety and inspection analysis, user reviews, and personal organization tools including notes, visit checklists, favorites, and a care-matching quiz.
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent. The App is not directed at children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).
Some features of the App require you to create an account using email or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us promptly of any unauthorized use.
Free Tier. The App offers core functionality at no charge, including facility search, basic facility information, and limited AI inspection analysis views per day.
Premium Subscription. Additional features may be available through a paid subscription, including unlimited AI analysis views, cloud data sync, and other premium features. Subscription pricing and terms will be displayed in the App at the time of purchase.
Billing. Subscriptions are billed through the Apple App Store or Google Play Store. Payment processing is handled entirely by Apple or Google, subject to their respective terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Refunds. Refund requests are handled by Apple or Google according to their refund policies. We do not process refunds directly.
You agree not to:
You retain ownership of content you create in the App (reviews, notes, checklists). By submitting a review, you grant CareLookout a non-exclusive, royalty-free, worldwide license to display that review within the App and on related services.
Review Policy. Reviews require physical proximity to the facility via a check-in process. This requirement exists to promote authentic, first-hand reviews. We reserve the right to remove reviews that violate these Terms, appear fraudulent, or violate our content guidelines. Reviews represent the opinions of individual users and do not reflect the views of CareLookout.
Notes and Checklists. Notes and visit checklists are private by default and stored locally on your device. If you opt into cloud sync, this data is stored in your private account and is not visible to other users.
Public Data Sources. Facility data displayed in the App is aggregated from publicly available government records, including state licensing agencies (e.g., California CCLD, New York State Department of Health) and the Centers for Medicare & Medicaid Services (CMS). We do not generate or modify the underlying government data.
AI-Generated Analysis. Safety analysis, inspection summaries, severity ratings, trend indicators, and search tags are generated by artificial intelligence. These are automated interpretations of public records and may not fully or accurately represent the underlying data. AI analysis is provided for informational purposes only.
Not Medical or Professional Advice. The App provides facility information and safety analysis for informational purposes only. Nothing in the App constitutes medical, legal, or professional advice. You should independently verify facility information and consult with qualified professionals before making care decisions.
Data Accuracy. Government-sourced facility data may not reflect the most current conditions. Inspection reports, compliance records, and facility details may be incomplete, outdated, or contain errors from the source data. We make reasonable efforts to keep data current but cannot guarantee accuracy or completeness.
No Endorsement. The inclusion of a facility in the App does not constitute an endorsement or recommendation. Rankings, severity ratings, and trend indicators are algorithmic and do not represent professional evaluations.
No Warranty. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, CareLookout and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from your reliance on information provided by the App, decisions made based on facility data or AI analysis, loss of data, or interruption of service.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $50, whichever is greater.
You agree to indemnify and hold harmless CareLookout and its operators from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, content you submit, or your violation of any rights of another party.
The App, its design, features, and content (excluding user-generated content and government-sourced data) are the property of CareLookout. You may not copy, modify, distribute, or create derivative works based on the App without prior written consent. Government-sourced data remains in the public domain.
You may delete your account at any time through the App's profile settings or by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your right to use the App ceases, and we may delete your data in accordance with our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CareLookout regarding your use of the App.
